Introduction
These Terms of Service ("Terms") govern your access to and use of the DarkScout platform, services, software, tools, dashboards, intelligence feeds, and related offerings provided by DarkScout LLC ("DarkScout," "we," "us," or "our"). By accessing our website, creating an account, subscribing to a plan, or using any part of DarkScout's threat-intelligence and monitoring services, you agree to be bound by these Terms. If you do not agree, you must not use our Services.
DarkScout is a U.S.-registered cybersecurity and threat-intelligence company headquartered in Denver, Colorado. Our Services include darknet monitoring, credential exposure detection, email security intelligence, attack surface mapping, cyber-risk analysis, and other related tools designed for both Business Customers and Individual Users.
These Terms apply to all users, including organizations, their authorized team members, and individuals using DarkScout for personal security purposes.
Policy Scope & Purpose
These Terms explain your rights and responsibilities, describe the features available under different subscription plans, and outline how we manage your account, data, and use of the Service.
Who This Applies To
● Business Customers:
Organizations and their authorized users (e.g., administrators, employees) subscribing to the Service.
● Individual Users:
Persons using the Service for personal, non-commercial purposes.
Why We Have This Policy
We are committed to ensuring that DarkScout's services are used safely, ethically, and legally, while protecting both our platform and our users. These Terms clarify acceptable use, plan features, data ownership, and user obligations.
Definitions
● Alert
A notification generated by the Service indicating a potential security incident, exposed credential, or darknet activity related to User Data.
● API / Integration
Application Programming Interfaces, connectors, or data feeds provided to Business Customers or Individual Users for integrating DarkScout services into other tools or platforms.
● Authorized Users
Users you designate under your Business Customer account who are permitted to access the Service on organization's behalf.
● Business Customer
An organization, company, or institution that subscribes to or uses the Service, including its authorized administrators, employees, or other team members.
● Confidential Information
Non-public technical, business, or threat-intelligence information disclosed by either party, whether in oral, written, or electronic form, that is designated as confidential or reasonably should be understood to be confidential.
● Content
Outputs generated by the Service, including dashboards, alerts, reports, analytics, threat intelligence, and related insights derived from User Data and monitoring activities.
● Data Retention Period
The duration for which DarkScout retains User Data, alerts, or generated Content, as defined in the Privacy Policy or plan-specific documentation.
● Individual User
A person using the Service independently for personal, non-commercial purposes.
● Monitoring Target
Any domain, email address, IP address, or asset submitted by a user to be monitored by DarkScout.
● Prohibited Use
Any use of the Service that violates laws, infringes IP rights, or is otherwise unethical, malicious, or harmful, as outlined in the Acceptable Use clause.
● Service
The DarkScout platform, software, tools, dashboards, intelligence feeds, APIs, reports, and all related offerings provided by DarkScout, including threat monitoring, credential exposure detection, email security intelligence, risk analytics.
● Subscription
A paid or free plan granting access to one or more modules or features of the Service for a defined period.
● Threat Intelligence Partner
Third-party service providers, analysts, or intelligence sources used to validate, enrich, or analyze data collected by DarkScout.
● User Data
Any data you provide to the Service, including domains, subdomains, email addresses, IP addresses, credentials, and other assets you wish to monitor or analyze.
License & Access
Limited License
DarkScout grants you a limited, non-exclusive, non-transferable, and revocable right to access and use the DarkScout platform and its available features, strictly in accordance with these Terms and the plan you have subscribed to. This access is provided solely for your own security-monitoring purposes and may not be resold or shared outside your organization or authorized team.
Account Registration
To access certain features, you may be required to create an account. You agree to:
- Provide accurate, current, and complete information;
- Keep your account credentials secure and confidential; and
- Be responsible for all activities conducted under your account, including those of Authorized Users in a Business Customer account.
Access Restrictions
Your access to DarkScout depends on the subscription plan you select. Certain features such as email monitoring, breach alerts, domain monitoring, or team invitation functionality may be available only to paid plans.
You shall not:
- attempt to gain unauthorized access to any part of the platform;
- interfere with the security, performance, or integrity of the Service;
- use the platform for unlawful activities;
- use automated bots or scraping tools to extract data from the Service without permission;
- attempt to access or monitor domains, emails, or assets you do not own or control.
Modifications and Updates
DarkScout may modify, suspend, or discontinue features of the Service at any time, without prior notice, provided that such changes do not materially reduce your access to features you have paid for under your Subscription.
Plan-Specific Access
Access to the platform is provided on a subscription basis. Your plan determines the number and type of features available to you, including monitoring limits, alert frequency, and available modules.
Subscription & Use of Services
Subscription Access
DarkScout Services are provided on a subscription basis. Your access begins when you create an account and activate a plan through the DarkScout platform or through an authorized DarkScout representative. Subscriptions may include features such as Darknet Monitoring, Credential Exposure Detection, Email Intelligence, Darkscout Ai, Risk Scoring, and access to interactive dashboards depending on the plan selected.
Subscription Term & Renewal
Your subscription remains active for the duration shown at the time of purchase. Unless otherwise specified or disabled from your account settings, subscriptions may automatically renew at the end of each billing cycle at the then-current pricing.
Plan Availability
Available features vary depending on the subscription tier selected. DarkScout may update, enhance, or modify plan features as part of ongoing service improvements.
Upgrades & Feature Add-Ons
You may upgrade to a higher tier or add certain features during your subscription term. Any upgrade will take effect immediately, and applicable charges will be prorated for the remaining billing period.
No Refunds
Except where required by law, DarkScout does not provide refunds for partially used subscription periods, canceled accounts, or unused services.
Usage Limits
Your use of the Service is subject to reasonable usage limits based on your selected plan.
Suspension for Violations
DarkScout may temporarily or permanently suspend access if your usage threatens platform security, violates these Terms, or disrupts service performance. When possible, DarkScout will provide notice and an opportunity to resolve the issue before suspension.
Use of the Services
DarkScout provides security-intelligence features such as darknet monitoring, credential exposure alerts, attack-surface visibility, and related cyber-risk insights. By using the Service, you agree to use these features only for lawful and legitimate security purposes.
You may access the Service only as permitted under your subscription plan and only in the manner described on the DarkScout website. Certain features (such as monitoring volume, number of tracked assets, alerts, or dashboard functions) may have usage limits based on your plan.
You are responsible for your use of the Service and for ensuring that any data, domains, emails, or assets you submit for monitoring belong to you or that you are legally authorized to monitor them.
DarkScout may impose fair-use limits to maintain platform stability and security. If your usage exceeds reasonable operational thresholds, DarkScout may request that you modify your usage or upgrade your plan. The Service may be updated, improved, or modified from time to time to enhance threat-intelligence accuracy, performance, security, or usability. These updates may occur automatically.
Service Subscriptions and Plan Features
DarkScout provides its Services through subscription-based plans. The specific features and capabilities available to you depend on the plan you select at the time of purchase. Subscriptions begin when your account is activated and remain valid for the duration of the subscription period displayed at checkout or in your order confirmation.
Your Subscription may include one or more of the following components, depending on your selected plan:
- Darknet Monitoring – continuous monitoring of darknet sources for exposed data, compromised credentials, or related security indicators.
- Credential Leak Detection – identification of breached usernames, passwords, email accounts, phone numbers, or login pairs found in leaked databases or illicit marketplaces.
- Email Exposure Intelligence – detection of exposed emails, mail server metadata, MX records, and email-related threat vectors.
- Darkweb Footprint Analysis – assessment of your organization's presence or exposure across darknet forums, marketplaces, breach repositories, and illicit data channels.
- Threat Alerts & Reports – notifications of verified findings, indicators, breach exposures, or risk events relevant to your monitored assets.
- Business Plan Features – includes advanced analytics, expanded asset coverage, organizational-level monitoring capabilities, and the ability for an account administrator to invite additional team members ("Authorized Users") to collaborate within the platform.
Some features may only be available in Business Plans, premium tiers, or custom enterprise packages. DarkScout may update or enhance features from time to time.
Billing, Payments, and Subscription Terms
Orders
Your access to DarkScout's Services is provided upon successful purchase of a subscription plan through the official DarkScout website or an approved ordering channel. An order is considered accepted once DarkScout confirms activation of your account or sends an order confirmation. All orders are governed exclusively by these Terms and are non-cancellable and non-refundable except as explicitly stated herein or required by applicable law.
Subscription Fees
Your access to DarkScout's Services is provided on a paid subscription basis. The fees applicable to your selected plan are displayed at checkout or in your order confirmation. All fees must be paid in full at the time of purchase unless otherwise agreed in writing.
Payment Authorization
By purchasing a subscription, you authorize DarkScout and its designated payment processors to charge your selected payment method for all fees, taxes, and any additional charges incurred under your account. You are responsible for ensuring your billing information is accurate and current.
Auto-Renewal
All subscription plans automatically renew at the end of the current subscription term unless canceled prior to the renewal date. Renewal fees will be charged at the then-current subscription rate. Continued access to the Service after renewal constitutes your acceptance of the updated pricing.
Price Changes
DarkScout may update subscription pricing in the future. Any price change will be communicated in advance and will take effect at the next renewal cycle. Continued use after the effective date constitutes acceptance of the updated pricing.
Refunds
Except where required by applicable law, all subscription fees are non-refundable. Refunds or credits may be granted only at DarkScout's sole discretion or if a specific policy of DarkScout explicitly permits it.
Taxes
Subscription fees are exclusive of taxes. You are responsible for all applicable taxes, duties, and government charges related to your subscription.
Failed Payments
If a payment fails or cannot be processed, DarkScout may:
- retry the charge,
- suspend access to the Service, or
- terminate your subscription if payment is not resolved within a reasonable time.
Account Security, Administrative Controls & User Responsibilities
You are responsible for maintaining the security of your DarkScout account and all activity occurring under it. Cyber-intelligence platforms involve sensitive data and monitoring functions; therefore, strict account-security obligations apply to both Individual Users and Business Customers.
Account Security Requirements
You agree to:
- safeguard login credentials, API keys, and authentication tokens;
- implement strong passwords and enable multi-factor authentication (MFA) where available;
- restrict access only to authorized individuals;
- immediately notify DarkScout of any unauthorized access, account compromise, or suspected breach.
DarkScout is not responsible for any loss or damage arising from unauthorized access resulting from your failure to secure your account.
Administrative Controls (Business Customers)
If you are a Business Customer, your designated administrator ("Admin User") has full authority to:
- invite and remove Authorized Users;
- assign user roles and access levels;
- manage monitored assets, domains, and integrations;
- control API usage, monitoring volume, and exported intelligence.
All instructions, changes, and actions taken by your Admin User are deemed authorized by your organization.
Responsibility for Authorized Users
You are solely responsible for:
- the conduct of all Authorized Users added to your account;
- actions performed through accounts you manage or invite;
- ensuring all Authorized Users comply with these Terms and applicable laws.
DarkScout may suspend or revoke access for any Authorized User whose behavior poses security risks or violates these Terms.
Internal Access Management
You must:
- promptly deactivate access for employees, contractors, or agents who leave your organization;
- review and update role permissions regularly;
- monitor internal activity for anomalous or unauthorized behavior;
- ensure users access only those features necessary for their role.
Failure to maintain proper internal access controls may result in suspension of suspicious accounts to protect platform integrity.
API Keys, Integrations & Tokens
If your Subscription includes APIs or integrations:
- API keys must be stored securely and must not be shared publicly, embedded in unsecured scripts, or exposed in repositories.
- You are responsible for usage originating from your keys.
- DarkScout may rotate, revoke, or limit API keys in cases of misuse, credential leakage, or security risk.
Notification Obligations
You must notify DarkScout immediately if you become aware of:
- unauthorized use of the Service;
- compromised credentials or API keys;
- misuse of DarkScout intelligence by any Authorized User;
- errors or anomalies suggesting a security threat.
Platform Integrity Protection
To protect the platform and its users, DarkScout may temporarily disable or restrict access to accounts exhibiting:
- unusual or abusive API behavior,
- suspicious login activity,
- excessive usage inconsistent with plan limits,
- activity threatening platform stability or data security.
DarkScout will provide notice where it is commercially reasonable and will restore access once the issue is resolved.
Product Warranties: Exclusions
Limited Performance Warranty for Hosted Intelligence Services
DarkScout warrants that, during an active subscription term, the Service will be provided with commercially reasonable administrative, technical, and organizational safeguards and will materially perform as described in the current DarkScout documentation applicable to your subscription tier. This warranty covers only the hosted, cloud-based intelligence and monitoring modules that DarkScout delivers directly and does not extend to outcomes, user actions, or third-party environments.
No Guarantee of Complete, Accurate, or Exhaustive Intelligence
DarkScout operates in a constantly evolving threat ecosystem that includes darknet markets, illicit breach sources, exposed-credential dumps, malware logs, and other unpredictable environments. Due to the inherent volatility of these sources, DarkScout does not warrant or guarantee that all exposures, leaks, or threat indicators will be detected, that all monitoring results will be complete or current, that all breached credentials or attack vectors will be discovered in time to prevent misuse, or that DarkScout's intelligence will represent every possible relevant data point.
No Warranty of Continuous, Error-Free, or Uninterrupted Service
DarkScout does not warrant that the Service will operate without interruption or that it will be free from downtime, latency, anomalies, false positives, false negatives, or technical inaccuracies. Scheduled maintenance, system updates, data-source instability, and reliance on external threat-intelligence providers may affect availability and performance.
No Cybersecurity Outcome Guarantee
DarkScout provides intelligence, alerts, insights, and monitoring to help improve situational awareness, but it does not provide any guarantee, representation, or warranty that the Service will prevent cyberattacks, unauthorized access, identity theft, fraud, malware infections, business email compromise, or other security incidents.
Service Provided "As Is" and "As Available"
Except for the limited warranty expressly stated above, the Service is provided on an "as is," "as available," and "with all faults" basis. DarkScout disclaims all other warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy of intelligence, completeness of results, system compatibility, or reliability of third-party data.
Third-Party Data and External Intelligence Sources
DarkScout may incorporate, validate, or enrich findings using third-party datasets, OSINT sources, commercial breach repositories, DNS intelligence feeds, or darknet crawlers that DarkScout does not own or control. DarkScout makes no warranty regarding the stability, accuracy, timeliness, or availability of any external data source.
Exclusions for Misuse
The warranties stated herein do not apply to any failure of the Service caused by misuse, abuse, unauthorized access attempts, violation of the Terms, use of the Service to monitor assets you do not own or control, failure to comply with documentation or usage limits, integration with unsupported environments, or interference caused by systems outside DarkScout's control.
Jurisdictional Exceptions
Some jurisdictions do not permit the exclusion of certain warranties. In such cases, DarkScout's warranties are limited only to the minimum extent required by applicable law.
Export Controls & Compliance with Laws
You agree to use the DarkScout Services only in full compliance with all applicable laws and regulations, including U.S. export control laws, sanctions regulations, and cybersecurity-related restrictions. DarkScout's platform, tools, intelligence data, and software may not be exported, re-exported, accessed, or used in or by individuals or entities located in embargoed countries, listed on U.S. or international sanctions lists, or otherwise prohibited under applicable law.
You represent and warrant that you:
- (a) are not located in, under the control of, or a resident/citizen of any restricted or sanctioned jurisdiction;
- (b) are not a party listed on any government-issued restricted or denied-party list; and
- (c) will not use the Service for unlawful monitoring, unauthorized surveillance, cyber exploitation, or any activity that violates export, data-protection, or cybersecurity laws.
DarkScout reserves the right to immediately suspend or terminate access to the Service if it determines that your use violates export-control requirements, sanctions laws, or any other applicable legal or regulatory obligations.
Waiver of Consequential Damages and Limitation of Liability
Waiver of Consequential Damages
To the fullest extent permitted by law, neither DarkScout nor its affiliates, partners, data providers, or suppliers will be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages. This includes, without limitation, lost profits, loss of revenue, loss or corruption of data, business interruption, loss of use, or the cost of procuring substitute services.
Limitation of Liability
Except where prohibited by law, DarkScout's total aggregate liability arising out of or related to the Service, these Terms, or any use or inability to use the platform will not exceed as applicable law requires. If you are using a free plan, trial, or non-paid access, DarkScout will have no liability of any kind.
Applicability of Limitations
These limitations apply to all claims, whether based in contract, tort, negligence, strict liability, or any other legal theory, and apply even if any remedy fails its essential purpose.
No Liability for Third-Party Sources
DarkScout is not responsible for the accuracy, availability, or performance of threat intelligence obtained from third-party sources, darknet repositories, public breach datasets, or external intelligence feeds.
Indemnification
You agree to indemnify, defend, and hold harmless DarkScout, its affiliates, officers, employees, and partners from any claims, damages, liabilities, losses, or expenses (including reasonable attorneys' fees) arising out of or related to: (a) your misuse of the Service; (b) any violation of these Terms; (c) monitoring or submitting assets, domains, or data you do not own or are not authorized to monitor; or (d) any reliance on, or use of, the intelligence or findings generated by the Service.
Termination
DarkScout may suspend or terminate your access to the Service if you violate these Terms, exceed permitted usage limits, engage in unlawful or unauthorized monitoring, or if continued access poses a security, operational, or legal risk. DarkScout will provide notice when reasonably possible, except where immediate suspension is required for security reasons.
You may terminate your Subscription by disabling auto-renewal or closing your account; however, all fees paid are non-refundable, and termination does not relieve you of outstanding payment obligations.
Upon termination, your access to the Service, dashboards, alerts, intelligence feeds, and associated features will end, and DarkScout may delete or restrict access to your data in accordance with its Data Retention Policy. Certain clauses including confidentiality, IP rights, limitations of liability, warranty exclusions, and indemnification will continue to apply after termination.
